1. WHAT INFORMATION DO WE COLLECT?

We only collect the information necessary to improve the app experience, keep it secure, and troubleshoot issues. Here's what we might collect:

Sensitive Information: We do not collect or process sensitive information, such as personal details, location, or hardware fingerprints about you or your child.

Application Data:

  • We automatically collect non-identifiable information when you use the app. This includes anonymous analytics, such as which features are used and when, to improve Kathy for everyone. No personal details, child-specific information, or location data are collected.

  • Push Notifications. We may request permission to send you push notifications about app features or reminders. Notifications are managed entirely on your device and are not routed through our servers. These will never be used for marketing. You can turn off push notifications in your device's settings at any time.

  • Crash Reports. If the app crashes, we may collect error reports through Apple or Google services. These reports help us identify and fix issues in future updates. These reports are anonymized and handled by the respective app stores.

2. HOW DO WE USE YOUR INFORMATION?

  • To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention.

  • To identify usage trends. By analyzing usage trends—like which features are used most—we can better understand what works and enhance the app experience for everyone.

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

We only process your data when we have a valid legal reason, as required by applicable laws. These reasons include:

If you are located in the EU or UK, this section applies to you.

Under the GDPR and UK GDPR, we rely on these legal bases:

  • Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose.

  • Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights. For example, we may process information to: (1) understand how the App is being used in order to improve it; (2) Diagnose problems and/or prevent fraudulent activities.

  • Legal Obligations. We may process your information where we believe it is necessary for compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, or to exercise or defend our legal rights.

  • Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party in rare emergencies.

If you are located in Canada, this section applies to you.

In some cases, Canadian law allows us to process data without consent, such as:

  • To comply with legal orders (e.g., subpoenas or court orders).

  • For fraud prevention or investigations.

  • If obtaining consent is impractical in a time-sensitive situation, such as an emergency.

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

  • We do not sell, share, or disclose any personal information to external parties. Kathy is designed to protect your privacy.

  • In the unlikely event of a merger, acquisition, or sale of our business, any data we transfer will remain anonymous and subject to the same privacy commitments outlined in this notice. We will ensure that any new entity continues to protect your data.

Because Kathy only collects anonymous usage data, any shared or transferred data cannot identify you, your child, or your devices.

5. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law.

When we have no ongoing legitimate business need to process your personal information, we will delete it where possible.

6. HOW DO WE KEEP YOUR INFORMATION SAFE?

We take the security of Kathy's data seriously. Although we do not collect personal or sensitive information, we have implemented robust technical and organizational measures to protect the anonymous data we process. These measures include secure storage practices and safeguards to prevent unauthorized access or misuse.

That said, no online system can be 100% secure. While the data we collect is anonymous and poses minimal risk, we recommend using our app in a secure environment (e.g., a trusted network) to further protect your experience.

7. WHAT ARE YOUR PRIVACY RIGHTS?

Your privacy is important to us. While Kathy only collects anonymous usage data, we want you to be aware of your rights under applicable privacy laws. These rights may vary depending on where you live.

If you are located in the EEA, UK, Switzerland, or Canada, you may have the right to:

  • Request access to and a copy of your personal information.

  • Request corrections or deletion of your personal information.

  • Restrict the processing of your personal information.

  • Object to the processing of your personal information in certain circumstances.

  • Withdraw your consent (if applicable).

Since Kathy collects only anonymous data, many of these rights might not apply.

If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.

Concerns or complaints

If you believe your rights are being violated, you may contact:

  • The relevant data protection authority in your country (e.g., in the EEA, UK, or Switzerland).

  • Canada's Office of the Privacy Commissioner for concerns specific to Canadian law.

8. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

Yes! If you are a resident of the United States, including California, you may have specific rights under state privacy laws. However, since Kathy only collects anonymous usage data, most rights related to personal information do not apply. Here's what you should know:

  • Kathy does not not collect, disclose, or sell any personal or sensitive information.

  • In the past 12 months, we have not shared personal data with third parties for business or marketing purposes, and we will not do so in the future.

  • In the past 12 months, we have not collected sensitive identifiers, personal information as defined in the California Customer Records statute, protected classification characteristics, commercial information, browsing information or online interests from third parties, geolocation data, audio/sensory or similar information, nor employment information.

Your Rights

Depending on your state, you may have the right to:

  • Know if we process personal data.

  • Access or request a copy of personal data.

  • Correct inaccuracies or delete personal data.

  • Opt out of data use for advertising, sale, or profiling

How to Exercise Your Rights

If you have any concerns, contact us at [email protected]. While our App doesn't collect personal information, we'll promptly address any inquiries.

California Residents "Shine The Light" Law

Under California law, residents can request details about personal data shared for direct marketing. Since we do not share any personal data, this does not apply to Kathy. However, if you'd like more information, contact us at the email above.

9. DO WE MAKE UPDATES TO THIS NOTICE?

Yes! We may update this Privacy Notice from time to time to reflect changes in our practices or legal requirements.

Any updates will be noted with a "Revised" date at the top of this notice. If there are significant changes, a future app update will require a parent or legal guardian to review the updated Privacy Policy to continue using the App. The most current version of this Privacy Notice is always available at: https://www.totaldramaqueen.com/privacy-policy.

We encourage parents and guardians to review this Privacy Notice occasionally to stay informed about how we protect your family's privacy.
